Amendments to the Workplace Safety and Health Regulation and the Administrative Penalty Regulation

The Government of Manitoba has announced its intention to “implement consensus recommendations from the Workplace Safety and Health Act Review Committee (Review Committee)”.
According to the Government, the change would “adopt mandatory training standards and certification requirements for those that work with asbestos or conduct asbestos sampling, establish a public registry of training providers and employers that work with asbestos or conduct asbestos sampling, and [would] require building owners to have the same responsibilities as employers related to asbestos”. The changes would also:
- “adopt the Workers Compensation Board of Manitoba (WCB) Asbestos Abatement Training Program Standard into law for those that work with asbestos-containing material”;
- “adopt the WCB Asbestos Surveyor/Sampling Training Program Standard into law for those that carry out asbestos inventories or sampling”;
- “require workers to be re-certified to the WCB standard to which they trained every three years”;
- “establish a public registry of employers that have certified workers and work with asbestos or conduct sampling/inventories”;
- “establish a public portal listing endorsed training providers for asbestos work”; and
- “include a transition period to provide time for compliance”.
The change would be made by amending the Workplace Safety and Health Regulation and the Administrative Penalty Regulation.
Ontario
Bill 30, Working for Workers Seven Act, 2025

The Government of Ontario has announced its intention to “create safer workplaces”, “[fight] worker abuse”, and “protect Ontario workers”. According to the Government, the change would notably include:
- “requiring automated external defibrillators (AEDs) on construction projects with 20 or more workers that are expected to last three months or longer”;
- “requiring employers to give employees impacted by a mass termination up to three unpaid days off to job search and access employment services”;
- “creating the authority to require public infrastructure project owners, constructors and employers to treat [the] Chief Prevention Officer-accredited health and safety management systems (HSMS) as equivalent in procurement processes”‘ and;
- “establishing the authority to create a new general Administrative Monetary Penalty (AMP) regime under the Occupational Health and Safety Act to help enforce the new Chief Prevention Officer-accredited HSMS requirements and strengthen overall workplace safety enforcement”.

- the Municipal Act, 2001,

- the Ontario Immigration Act, 2015,

Saskatchewan
Engagement on The Occupational Health and Safety Regulations, 2020

The Government of Saskatchewan is seeking feedback on potential amendments to The Occupational Health and Safety Regulations, 2020. The proposed changes may address several areas, including:
- employer and/or contractor notification requirements for serious injuries, fatalities, dangerous occurrences, and high-risk asbestos processes;
- regulatory provisions related to youth employment;
- requirements for occupational health and safety programs;
- employers’ duty to investigate accidents and restrictions on interference at accident scenes;
- working alone or in isolated places of employment;
- harassment and violence in the workplace;
- roles of occupational health committees and representatives; and
- harmonization of first aid requirements.
Interested parties may submit feedback until November 30, 2025.

Phasedown of Hydrofluorocarbons: Reconsideration of Certain Regulatory Requirements Promulgated Under the Technology Transitions Provisions of the American Innovation and Manufacturing Act of 2020

The U.S. Environmental Protection Agency (EPA) is proposing “changes to regulations promulgated under the Technology Transitions section of the American Innovation and Manufacturing Act of 2020, which authorizes the Administrator to restrict the use of particular hydrofluorocarbons in [certain] sectors”.
According to the government, the proposal “addresses administrative petitions and other requests from companies and trade associations across a number of subsectors, including refrigerated transport—intermodal containers, industrial process refrigeration and chillers for industrial process refrigeration used in semiconductor manufacturing, retail food refrigeration systems for remote condensing units and supermarkets, cold storage warehouses, refrigerated laboratory centrifuges, laboratory shakers, and condensing units in residential and light commercial air conditioning and heat pumps”.
The changes would notably:
- “adjust the temperature threshold and location where the temperature will be measured for restrictions on transport refrigeration—intermodal containers”;
- “provide a graduated schedule for the use of [hydrofluorocarbons (HFCs)] in new remote condensing units and supermarket systems” and “new cold storage warehouses”; and
- delay and/or remove certain compliance dates.
Interested persons are invited to submit comments by November 17, 2025.

European Union
Proposal for a Regulation of the European Parliament and of the Council amending Regulation (EU) 2023/1115 as regards certain obligations of operators and traders

Industry Sector: Forestry and Logging
The European Commission has announced its intention to lighten the reporting burden for operators and traders under the Regulation on Deforestation-free Products (EUDR). According to the content of the proposal, this would be made in particular by amending Regulation (EU) 2023/1115, focusing on:
- introducing two new categories of operators: “micro and small primary operator” and “downstream operator”, to provide “simplifications for most subjects of obligations and significantly [lower] the number of due diligence statements to be submitted in the information system”; and
- aligning related timelines to provide micro or small undertakings with adequate time for the implementation of the proposed amendments.
