Amended Document – Canada Occupational Health and Safety Regulations
Amending Document – Regulations Amending Certain Regulations Made Under the Canada Labour Code (Respiratory Protective Equipment)

The changes to this document are part of a suite of amendments to occupational health & safety regulations that notably “allow CSA Group certified [respiratory protective] equipment to be provided as an alternative to [National Institute for Occupational Safety and Health] certified equipement in federally regulated workplaces, where there is a risk of injury or disease due to exposure to an airborne hazardous substance and the equipment does not provide air” and incorporate by reference certain respiratory protection provisions and naming conventions from relevant CSA Standards. A further change to this document aligns the percentage level in an oxygen-deficient atmosphere throughout the document.

Other amended documents include the Administrative Monetary Penalties (Canada Labour Code) Regulations, Maritime Occupational Health and Safety Regulations, On Board Trains Occupational Health and Safety Regulations, and Oil and Gas Occupational Safety and Health Regulations.

Amended Document – Pest Control Products Regulations
Amending Document – Regulations Amending the Pest Control Products Regulations (Ultraviolet Radiation-emitting Devices and Ozone-generating Devices)

The amended document notably “prescribe[s] UV and ozone-generating devices as pest control products in Schedule 1” (“Prescribed Devices”) that require registration, with certain exceptions, clarifies that these regulations apply to “ultraviolet radiation-emitting devices” and “ozone-generating devices”, as defined herein, exempts Class II, III, and IV medical devices that are regulated by the Medical Devices Regulations from the application of these regulations, requires that UV and ozone-generating devices which are manufactured for export “be permitted on the basis that the manufacturer meets the labelling requirements for safe transport and certifies that the exported product meets the legal requirements in the importing country,” establishes certification, design, and labelling conditions under which UV devices would not require registration, and allows access to the UV component of authorized UV devices, “provided there are instructions related to safe handling and disposal procedures.”

Canada – Alberta

Amended Document – Directive 020: Well Abandonment

This Directive sets the requirements for abandonments, casting removal, zonal abandonments and plug backs as required under s.3.013 of the Oil and Gas Conservation Rules (Alta.Reg.151/1971). The directive applies to all open-hole and cased-hole abandonments. Routine abandonments, those abandonments that comply with the requirements found in this Directive do not require approval by the Alberta Energy Regulator (AER). Non-routine abandonments, those that do not meet the requirements of this Directive, do need approval from the AER before work may be started.

This edition, according to the Alberta Energy Regulator (AER), clarifies provisions regarding “AER notification,” “remedial cementing of porous intervals and protected intervals,” and “setting of a permanent bridge plug and permanent packer.” Other amendments provide that Directive 087: Well Integrity Management contains “suggested procedures for gas migration testing and surface casing vent flow testing.”

The amended document notably to make various changes to occupational health and safety rules for the logging industry, including to:

• revise the definition of “logging operation” to include the delimbing, cutting to length, processing on site and extraction of trees;
• require employers to ensure that an effective communication plan is in place for employees;
• require employers to develop a code of practice to protect employees from possible environmental conditions;
• require powered mobile equipment be equipped with safe means of access and egress, and cleats or corks when woods roads are frozen;
• establish rules for the safe transportation of powered mobile equipment;
• introduce additional personal protective equipment requirements for the industry, rules for safe felling of standing dead trees, and rules for cable logging systems; and
• expand rules for loading operations.

The changes also more broadly:

• • add definitions of various terms, including “occupational exposure limit”;
  • require that places of employment be adequately ventilated in accordance with relevant industrial standards;
  • incorporate by reference various updated industry standards;
  • require employers to ensure that engineering controls are designed, installed and maintained in accordance with good engineering practices;
  • require employers to provide respirators (and employees to wear them) in certain circumstances;
  • require employers to control levels of air contaminants using local exhaust ventilation systems, and provide rules for the use and maintenance of such systems;

• replace various references to a “threshold limit value” with “occupational exposure limit”; and
• introduce a code of practice for employers and employees who work with or in proximity to asbestos.

Amending Document – An Act to Amend Chapter 25 of the Acts of 2004, the Electricity Act

The amended document notably permits customers to generate their own electricity using a renewable low-impact generator or energy storage device with a total nameplate capacity of 27 kilowatts or less, allows subscribers to offset their electricity bill if they generate enough power from renewable sources such as solar panels, and allows authorized persons to apply to the Province’s Green Choice Program to procure renewable low-impact electricity.

New Principal Document – Act ending exploration for petroleum and underground reservoirs and production of petroleum and brine

This document prohibits exploration for petroleum and production of petroleum and brine, and exploration for underground reservoirs to explore for, store, or product petroleum or brine. It also revokes petroleum exploration and production licences, provides for a compensation program for revoked licenses, and requires holders of revoked licenses to permanently close wells and restore sites.

Amended Document – Environment Quality Act
Amending Document – An Act mainly to reinforce the enforcement of environmental and dam safety legislation, to ensure the responsible management of pesticides and to implement certain measures of the 2030 Plan for a Green Economy concerning zero emission vehicles

The amended document notably:

• revises the definition of “person” to include trusts and any other groups of persons;
• requires persons responsible for the accidental release of a hazardous material to recover, clean, or treat the matter contaminated by the release;
• provides additional circumstances in which authorization holders are required to obtain an amendment to the authorization before changing their project and what information must be included in the amendment application;
• provides a 90-day period for the submission of reports and certificates concerning rehabilitation plan works;
• prohibits the use, sale, and possession of devices for tampering with motor vehicle pollution control systems;
• introduces additional record-keeping requirements relating to the release of hazardous material into the environment;
• establishes cases in which a person who has custody of land must apply for the registration of a notice of land use restriction in the land register; and
• revises various penalties and fine amounts.

The amended document notably provides that a “pesticide” includes pest control products registered under the federal Pest Control Products Act and seeds coated with pesticides, provides that it applies to pesticide waste and pesticide-contaminated waste and all activities relating to the manufacture, sale, and work relating to pesticides, “establish[es] rules for the possession of pesticides,” requires permit holders to inform the Minister of the cessation of their activities within 30 days of the cessation, introduces penalties and revises fine amounts.

The amended document notably lists “the refrigerant 2,3,3,3-tetrafluoroprop-1-ene, also known as HFO-1234yf or R-1234yf, as acceptable, subject to use conditions, in the motor vehicle air conditioning end-use for certain types of newly manufactured nonroad (also called off-road) vehicles, which includes some vehicles that are also considered heavy-duty vehicles,” incorporates by reference updated industry safety standards concerning motor vehicle refrigerants and safety mechanisms, and requires “unique servicing fittings for use with small refrigerant cans (two pounds or less) of 2,3,3,3-tetrafluoroprop-1-ene that are used to service onroad and nonroad vehicles.”

The amended document notably confirms the risk assessment and determination that “the risks from the Mercury Cell Chlor-Alkali Plants source category are acceptable, the 2003 standards provide an ample margin of safety to protect public health, and more stringent standards are not necessary to prevent an adverse environmental effect,” revises the Maximum Achievable Control Technology (MACT) standards to prohibit mercury emissions from existing mercury cell chlor-alkali plants, revises “requirements for cell room fugitive mercury emissions to require work practice standards for the cell rooms along with instrumental monitoring of cell room fugitive emissions” while emissions are gradually eliminated, and requires the implementation of work practices to minimize chlorine emissions from mercury cell chlor-alkali processes.

New Principal Document – 10 CFR 460 Energy Conservation Standards for Manufactured Homes

This document, according to its content, “establishes energy conservation standards for manufactured homes as manufactured at the factory, prior to distribution in commerce for sale or installation in the field. A manufactured home that is manufactured on or after May 31, 2023 must comply with all applicable requirements of this part.” Its requirements are applicable based on established climate zones of the U.S. States and Territories, and include those concerning building thermal envelopes, insulation and air barrier installation, and HVAC, service hot water, and equipment sizing.

It principally adds certain banned substances, such as benalaxyl, beta-cyfluthrin, bromoxynil, chlorpyrifos, chlorpyrifos-methyl, epoxiconazole, and mecoprop to the list of chemicals subject to export notification procedure and the list of chemicals qualifying for PIC (the Prior Informed Consent) notification and revises the export ban list to reflect the supplement of certain chemicals and articles, as well as the export bans of mercury.

The amended document contains new rules governing the working conditions of pregnant employees. The change establishes provisions for the mandatory return to face-to-face work activities. Under the new rules, unless the employer decides to maintain remote working, a pregnant employee must return to face-to-face work after the end of the COVID-19 health emergency, after their complete vaccination against COVID-19, and by signing a term of responsibility and free consent for face-to-face work (and exercising their option to not be vaccinated against COVID-19). Other amendments provide that if a pregnant employee has not been fully immunized against COVID-19, they must conduct their work activities remotely without prejudice to their remuneration.

The changes notably amend the tables related to occupational exposure to chemical agents, including “Biological Indicators of Excessive Exposure” and “Biological Exposure Indicators with Clinical Significance”, radiological and spirometry (the most common type of pulmonary function or breathing test) control of exposure to chemical agents, including “Frequency of Radiological Examinations for Employees Exposed to Dust Containing Silica, Asbestos or Mineral Coal” and “Frequency of Radiological Examinations for Employees Exposed to Dust Containing Insoluble or Poorly Soluble Particles of Low Toxicity and Not Otherwise Classified”, and occupational medical control of exposure to hyperbaric conditions for work in the construction industry. Notably, it creates a new section under the “Environmental Code” covering obligations for certain aircraft operators to compensate for GHG emissions from flights performed within the national territory and establishes conditions for carbon credits from certain GHG emission reduction or sequestration projects to be considered compliant with offset obligations.

This document sets out a minimum percentage of emission reductions generated by projects located in the European Union (EU) to comply with the compensation obligations of certain aircraft operators. The document also includes conditions for the reduction percentage to increase gradually between 2022 and 2025, obligations to assess aircraft operators’ compliance with this percentage, and a price cap for carbon credits beyond which operators are exempted from applying this rate if they are unable to find projects in the EU whose carbon credit price is below this limit.

This document is related to the new section of the Environmental Code created by Decree n° 2022-667 of April 26, 2022 concerning the compensation of greenhouse gas emissions.
