Canada – Alberta

According to the Government of Quebec, the change notably:

  • “amends the scope of the Regulation respecting halocarbon destruction projects eligible for the issuance of offset credits such that only projects for the destruction of halocarbons contained in insulating foam from refrigeration, freezer or air-conditioning appliances are eligible for the issuance of offset credits”;
  • removes “from the definition of halocarbon the halocarbons used or intended to be used as refrigerants for refrigeration, freezing or air conditioning in equipment, systems or appliances from industrial, commercial, institutional or residential sources”;
  • removes “all conditions and methods applicable to projects for the destruction of this type of halocarbon”;
  • “removes certain pieces of the information that promoters are required to send to the Minister as part of the summary description of the project and the information about its location, including the identification of all project sites”; and
  • allows “in certain circumstances, that the visit of halocarbon destruction facilities be conducted only once every 3 years.”

Canada – Saskatchewan

New Principal Document – The Wildlife Control (Capsaicin) Products Regulations

United States – Federal

New Principal Document – 40 CFR 118 Clean Water Act Hazardous Substances Facility Response Plans

According to its content, this document establishes “hazardous substance facility response plan requirements for the owner or operator of any non-transportation-related onshore facility that, because of its location, could reasonably be expected to cause substantial harm to the environment by discharging [Clean Water Act (CWA)] hazardous substances into or on the navigable waters, adjoining shorelines, or the exclusive economic zone.” It contains criteria detailing its applicability, general requirements, rules for appealing the applicability criteria, exceptions and exemptions, and applicability to hazardous substance mixtures. It also requires facilities to model “a worst case discharge scenario” and to provide facility response training, drills, and exercises to employees.

United States – Indiana

According to the government, the amended document “provides that the following apply with respect to the owner of a building, structure, or dwelling, other than a multi-family residential property that contains more than four dwelling units, that is served by a customer owned lead service line within or connected to a water utility’s system:”

  • that an owner must replace the customer-owner portion of a lead service line, if requested by the water utility, by “(A) enrolling in the water utility’s lead service line replacement program; or (B) replacing the customer owned portion of the lead service line through the owner’s own agents or contractors and at the owner’s own expense”;
  • “that if the owner: (A) does not enroll in the water utility’s lead service line replacement program; (B) does not replace the customer owned portion of the lead service line; or (C) fails to communicate with the water utility regarding the replacement; the water utility or the water utility’s agent may enter the property to replace the customer owned portion of the lead service line”;
  • “that the: (A) water utility; and (B) occupant of the property, if the property is occupied by a person other than the owner; are not liable to the owner with respect to any replacement made under these provisions” and;
  • “that if a water utility attempts to avail itself of the remedies set forth in these provisions and is prevented from doing so by the owner of the property, the water utility may, in accordance with state law, disconnect water service to the owner’s property.”

The changes also “[provide] that the following apply with respect to the owner of a multi-family residential property that contains more than four dwelling units:”

  • “that the owner may elect to participate in the water utility’s lead service line replacement program”;
  • “that the owner must communicate to the water utility the owner’s election to participate not later than 45 days after receiving the water utility’s request;
  • “that if the owner does not communicate the owner’s election to participate within this 45 day period, the owner, or any future owner of the property, is responsible for replacing the customer owned portion of the lead service line through the owner’s own agents or contractors and at the owner’s own expense” and;
  • “that in the case of a: (1) building; (2) structure; or (3) dwelling; that a water utility has determined to be abandoned or unserviceable, the water utility may disconnect water service to the property and require the owner, or any future owner, of the property to install a new service line.”

According to the government, the amended document “provides that a person may perform certain activities without obtaining a permit from the department of natural resources (department)” and sets out rules “for cutting, relocating, or removing logs that are crossways in a channel.” It also “provides that a person who removes a logjam from a river or stream: (1) is not required to cut a log or separate a tree from its root system if, in the opinion of the person, the cutting would create an unreasonable risk of bodily harm to the person; and (2) need not remove the dislodged logs from the floodplain if the logs are dried and burned so completely as to eliminate the potential for a new logjam.” Finally, it allows the removal of a logjam or debris under certain conditions.

United States – Maine

According to its content, this document establishes a “grant intended to compensate commercial farms for time expended on activities that are common to most farms upon the initial discovery of [perfluoroalkyl and polyfluoroalkyl substances (PFAS)] contamination, such as time spent with [the Department of Agriculture, Conservation and Forestry (DACF)] field staff, time spent strategizing how to respond, and time spent communicating with customers.” It sets out eligibility criteria and documentation requirements for the grant.

Austria

Denmark

New Principal Document – Executive Order on measures to prevent the risk of cancer when working with substances and materials

This document applies to work involving the manufacturing, use, handling, and exposure to carcinogenic, mutagenic, or reproductive toxic substances and materials. It specifies general requirements for businesses and their employees to prevent risks associated with these hazardous agents. Key requirements include prohibitions on certain substances, mandatory substitution of less harmful alternatives, workplace assessments, measures for handling and labeling, and specific training and instruction for employees. The document also outlines procedures for obtaining necessary approvals and reporting accidents involving hazardous substances.*

It replaces the Executive Order on measures to prevent the risk of cancer when working with substances and materials. The changes notably:

  • clarify the materials to which the amended regulations apply based on their properties and concentrations;
  • clarify that a carcinogenic, mutagenic or reprotoxic substance or material must not be used if it can be removed or replaced by a non-hazardous or less hazardous substance, material or process;
  • introduce regular training requirements related to the exposure to carcinogenic, mutagenic or reprotoxic substances in the workplace;
  • provide for provisions on exposure control approaches in various circumstances, such as when it is not technically feasible to use a closed system and when it is not technically feasible to use or produce a reproductive toxicant with a threshold in a closed system;
  • require employers to conduct medical surveillance examinations for employees working with substances or materials that have a biological limit value; and
  • update the classification and limitations for certain substances. 

Hungary

Poland

New Principal Document – Regulation of the Minister of Agriculture and Rural Development of February 14, 2024 on occupational health and safety when operating tractors, machines, tools and technical devices used in agriculture

Equipment must have protective guards, necessary tools, and instructions in Polish or the operator’s language. Maintenance and repairs must be performed with the equipment turned off and secured.

Saudi Arabia

For such buildings, the building manager must now ensure food waste is separated from other types of waste and provide a specific premises where building occupants can dispose of food waste separately. The building manager must then treat or have treated the food waste separately in a specified manner. Finally, the building manager must now report certain information on food waste collected and treated on a yearly basis to a government agency, as well as maintain records of certain other information on food waste.

United Arab Emirates – Abu Dhabi

New Principal Document – Decision of the Chairman of the Board of Directors of the Environment Agency – Abu Dhabi No. (8) of 2023 Regarding the issuance of the Invasive Marine Species Policy in the Emirate of Abu Dhabi (2023 – 2027)
